Terms & Conditions

These Terms & Conditions ("Terms") govern access to and use of the Tosio platform — the website, reception desktop application, and waiter mobile application (together, the "Service"), operated by Tosio ("Tosio", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and Accounts

You must be authorized to act on behalf of the restaurant business you register. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of your account credentials, and for all activity that happens under your account and any staff accounts you create.

2. The Service

Tosio provides restaurant management software, including point of sale, kitchen display, QR/online ordering, table and reservation management, GST-compliant billing, a reception desktop application for printing, and a waiter mobile application. Features may be added, changed, or removed over time.

3. Subscription and Billing

Access to the Service is provided on a subscription basis for the term you select (1, 6, or 12 months) at the price shown at checkout. Fees are billed in advance for the term selected and are processed by our payment partners, Razorpay and/or Stripe. Except where required by law, fees already paid are non-refundable.

You are responsible for any taxes applicable to your subscription. GST, where applicable, is charged in addition to the listed price.

4. Your Content and Data

You retain ownership of the menu, order, staff, and customer data you input into the Service ("Your Content"). You grant Tosio a license to use Your Content solely to provide, maintain, and improve the Service — for example, generating a 3D preview of a menu item you submit for that feature, or printing a receipt through the reception app.

You are responsible for having the necessary rights and permissions for any content you upload, and for your staff's and customers' data being provided to us in compliance with applicable law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable food safety, tax, or consumer protection law.
• Attempt to gain unauthorized access to the Service, other restaurants' data, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse engineer or attempt to extract the source code of the Service, except where permitted by law.

6. Third-Party Services

The Service relies on third-party providers for payments (Razorpay, Stripe), hosting (AWS), real-time messaging (Pusher), email (Resend), SMS (MSG91), and 3D model generation (Meshy AI). Your use of payment features is also subject to those providers' own terms.

7. Service Availability

We aim to keep the Service available and reliable, including offline order queueing in the waiter app for connectivity gaps, but we do not guarantee uninterrupted or error-free operation. We are not liable for losses caused by outages, maintenance, or factors outside our reasonable control.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated, if fees are not paid, or if required by law. Upon termination, your right to access the Service ends; we will retain data only as described in our Privacy Policy.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Tosio is not liable for indirect, incidental, or consequential damages arising from use of the Service, including lost revenue or lost data.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of India.
